The impunity laws are declared unconstitutional

"Honorable Judge Gabriel Cavallo had declared the Full Stop and Due Obedience Acts unconstitutional back in March 2001 in connection with the so-called "Simon's case." This case reached the Supreme Court of Justice of the Nation, which in its 2005 ruling held that "to the extent that, like all amnesties, [acts] are aimed at 'forgetting' about serious human rights violations as they are contrary to the provisions of the American Convention on Human Rights and the International Covenant on Civil and Political Rights. Consequently, they are not constitutionally acceptable." Similarly, on May 5, 2004, the National Public Prosecutor Esteban Righi confirmed the ruling handed over by his predecessor in office, Nicolás Becerra, who ruled that the Clean Slate and Due Obedience Acts were contrary to the national and international legal system.

The ruling allowed for the reopening of the judicial process. During the following months, investigations into crimes that had occurred three decades earlier began to resume in many jurisdictions across the country.
